BCU researcher publishes chapter on Medical Tribunals

  Dr Friso Jansen, a Senior Lecturer in Law, Director of Doctoral Studies and Associate Director of the Centre for Law, Science and Policy, has contributed a book chapter to the Edward Elgar book on Clinical Guidelines and the Law of Medical Negligence. 

The book, which was published in 2021, critically explores the dynamic relationship between clinical guidelines and medical negligence litigation. Dr Jansen’s chapter focuses on a comparative view of medical tribunals in England and the Netherlands. 

The chapter relates to Dr Jansen’s work in the Centre for Law, Science and Policy, which focuses on developing realistic tribunal simulations for healthcare profession students.

Medical Tribunals 

Dr Jansen’s chapter examines how medical tribunals are under increasing scrutiny from two perspectives. On the one hand, there are complaints that (para)medical professionals are treated too leniently and get away with sub-standard care. On the other hand, there are claims that these tribunals are too punitive. 

Dr Jansen’s research aims to understand how medical tribunals construct their decisions through exploring the similarities and differences between England and the Netherlands. Dr Jansen’s chapter highlights how tribunal decisions are driven in large part by the desire for a medical professional to show sufficient insight into their failings, but the way this is applied varies greatly between countries.
